Martha Stewart's attorneys revealed new information today that puts the government's indictment against her into serious question. Attorneys want to know how secret information contained in the grand jury indictment mysteriously showed up in the media before it was officially released. As we have been documenting for months, information from the investigation has been systematically leaked to the media in a campaign that seems designed to deny Martha Stewart a fair hearing in court. The question is and has been for some time, if the evidence against Martha is as strong as prosecutors claim, why does this secret information keep dripping out? Somebody needs to stick a cork in it, and by "it" we don't mean in Sammy Sosa's bat.

Martha Stewart Lawyers Urge Probe of Media Leaks--Reuters
Lawyers for Martha Stewart on Monday asked a federal judge to order an investigation of possible leaks to the media in the obstruction of justice case against the lifestyle trend-setter. Stewart's lawyers said during a hearing in federal court that the U.S. government should conduct a probe of the U.S. Attorney's office, the FBI, the Securities and Exchange Commission and the Justice Department to determine the source of possible leaks to the press about the case.

Paparazzi staking out Sam Waksals SoHo apartment have so far come up dry. Sam made it in through the back door on Saturday, and so far there has been little action outside the apartment, with just a female friend of Sam's arriving in a silver Mercedes SUV for an evening visit. But that friend wasn't Martha. Look for most of the western media to be present on Wednesday as Sam Waksal emerges to make his trip to the Schuylkill Federal Correctional Institution in Minersville, Pa.

Samuel Waksal's brother Harlan is leaving ImClone, ending the scandal-hit biotechnology group's managerial ties to the Waksal family. The move comes as ImClone tries to restore a reputation severely damaged by fall-out from an insider trading scandal. Harlan was ImClone's chief operating officer in December 2001 when the US Food and Drug Administration rejected ImClone's application for Erbitux, a cancer drug.

Looks like Judge Miriam Goldman Cedarbaum is a bit more reasonable than certain prosecutors have been. She has relaxed an earlier decision that requires Martha's presence in court every time a lawyer sneezes, and has allowed her to avoid the media circus today that would accompany Martha to the ladies room if cameras were allowed in. Martha may not attend the proceedings, but Martha's lawyers will be back in court today with new motions that could challenge the grand jury indictment and hopefully get this case thrown out with the trash. That's not likely, but we can dream...

How did grand jury "forget" about insider trading?

Martha Stewart's lawyers return to court on Monday, and motions have been filed which could result in the case being thrown out along with all the ridiculous charges against her. Martha's attorneys have filed new motions which will be revealed in court. At issue is how the grand jury was led from an insider trading investigation to an indictment that does not even charge Martha Stewart with that crime. Why did they not charge Martha with the issue at the heart of the investigation? Were they given all the information that was available, or was the whole case put on spin cycle? It has been said a grand jury can indict a ham sandwich, but the real ham may be the prosecutor who presented the case, and who may have forgotten to butter his bread on the right side...

Imclone founder to begin prison sentence--Washington Times
This was the last free weekend for a while for convicted insider trader Sam Waksal, who reports to a federal prison Wednesday. Waksal will do his time at the Schuylkill Federal Correctional Institution in Minersville, Pa., a minimum security facility of white collar criminals.

In spite of an all-day NY Post stakeout of Sam Waksals apartment on Saturday and Sunday, the former ImClone CEO was evidently able to elude the paparazzi with a quick last-ditch move.

Driving up to the front entrance of his Soho building in a black Ford Explorer, Waksal was at the wheel wearing a brightly colored Hawaiian shirt . His expression was relaxed, even happy, and he looked like anything but a man who is facing seven years in jail for insider trading.

After spotting a photographer camped outside his front door, Waksal switched places with another passenger in the car, hopping out of the drivers seat and into the back of the SUV, which then sped off and circled the block, where Sam was able to enter his building unmolested through the West Broadway entrance. To reporters chagrin, neither Martha Stewart nor Mick Jagger showed up for a visit.

We counted at least eight different NY Post reporters on the Soho stakeout throughout the weekend, and that doesn't include the team that was sent to the Hamptons to track Sam Waksal on his final visit before he is incarcerated. Either the NY Post is planning a special Sam Waksal pullout section, or it was a very slow news day. If readers wonder why that paper isn't devoting as many of it's resources to more important stories like the hunt for weapons of mass destruction or Bush's economic policy, perhaps that's because it is hard to photograph and report on something that's not really there.

On Wednesday, the disgraced ImClone founder will hunker down with 307 other white-collar criminals, corrupt politicians and drug offenders for a seven-year stretch at a federal prison "camp" on wooded acreage in rural Pennsylvania.

But Waksal needn't fear the clang of a prison door slamming behind him. There are no bars on the cells of Schuylkill Federal Correctional Institution and no barbed-wire fences surrounding the property in Minersville, in mid-eastern Pennsylvania.

Sam Waksal is scheduled to begin serving his sentence on Wednesday, becoming the first chief executive implicated in recent prominent corporate scandals to go to jail.

Mr. Waksal's sentence — the maximum recommended by the federal sentencing guidelines — may send a strong message to corporate executives that those who are caught breaking the law will be dealt with harshly. But will it really change the way businesses are run?

"I don't think it's really going to accomplish anything," said Daryl Koehn, director of the Center for Business Ethics at the University of St. Thomas in Houston. "It's a distraction."

But her "neighbors' don't live there either, the building is still under construction! Douglas Faneuil had held a stockbroker's license for just four months before he took the phone call from Martha Stewart that mobilized a federal investigation and that set him up as star witness, an unassuming former pizza boy from Newton who could bring down the celebrated queen of good taste.

Faneuil's friends were shocked at his involvement. This was the quiet young man who played a nerd in the Newton South High School senior show and who labored passionately as a student activist in college. The middle picture's width is reduced 25%, and looks much closer to the real Martha we know and love, seen on the right just four weeks ago. So did Martha really gain 100 pounds in a month, or is the Enquirer using funny lenses and Photoshop to make the picture tell a story? In a strange coincidence, the very same issue contains six full page ads for weight loss products, each with 1-800 numbers so advertisers can track their results. Is it true, or do pictures also lie? Deconstructing Byron Vol. 17

Scheming Times

In chapter 16 of Martha Inc. Chris Byron makes no bones about the fact that in the late 1990s, Martha Stewart was a hot commodity. So hot, in fact, that just about everyone was scheming to score some sort of deal with her, or undermine her deals with others.

Byron does a great job of analyzing and providing details about the behind-the-scenes strategies that helped make Martha who she is today. And yet, the most glaring omission of all remains the subject this book claims to be about – Martha! As in all of his previous chapters, there is zero input from Martha, leaving a vast ocean of details uncharted and unexplored. Byron can talk about the deals that were going around Martha, but not the deals Martha herself was involved in, nor can he provide her perspective on these matters.

Wouldn’t it have been great, for instance, to hear about all the wonderful details that were discussed at Martha’s kitchen table with Sharon Patrick? These are non-existent in Martha Inc. because Martha would have nothing to do with Byron’s sleazy aims.

It is for this reason that this book reads like a child’s gossipy diary, even if it disguises itself as a professional biography that is supposedly about Martha’s business. Martha’s deals, her thoughts and strategies and her entire perspective are missing elements from a book that purports to be about her! And so Byron fills the void with gossip, hearsay and a ramshackle retelling of events that went on in the periphery of Martha’s world. (

Why the case against Martha Stewart is unfair

Despite the fact that several other people who have done exactly what Martha Stewart has been charged with doing have not been charged or have only been fined, government investigators have publicly said they believe Martha should go to jail.

Why are these people being treated better than Martha Stewart? Sam Waksal's daughter Aliza and father Jack both sold ImClone shares on the same day as Martha. They had inside information. Aliza saved $630,000. But neither of them has been charged. And in a little noticed case, Eric Tsao sold 2000 shares of ImClone on inside information (Martha sold fewer than 4,000), Tsao lied to SEC investigators, and he made $50,000 in profits (Martha saved less than $60,000). He also used inside info to make another $100,000 on two other companies shares. So is Eric Tsao going to jail? Don't count on it; he was fined and barred from serving as an officer of a publicly traded company. Why is Martha Stewart being treated differently?

Martha is high profile, a celebrity, a success story. Everyone knows Martha, and that's why they want to make her an example. Lawyers for Martha Stewart file new motions
Fans to Investigators: Indict This!

The NY Times reports that Martha Stewart's lawyers are gearing up for the January trial, and have filed several motions, including one related to the grand jury that indicted her. It is said that grand jury can indict a ham sandwich, but we doubt they were even allowed to use one of Martha's recipes. One big question is how they got the grand jury to indict Martha for just about everything except insider trading! Details of the motions will be discussed in a hearing scheduled for July 21. The other big question: what will Martha wear?

Meanwhile, Sam Waksal is due to surrender on July 23 for a seven year jail term. Waksal was released from house arrest on July 4 to visit his parents in the Hamptons, only to be chased for several blocks around the West Village by photographers from the NY Post. Save Martha, one year later...

To combat all the negative media coverage and to provide a place where fans could rally their support for Martha Stewart, SaveMartha was launched one year ago this week. We thought the case would be wrapped up within a few months, but we were wrong. We also thought the case would be settled or dropped, since it was obvious that the laws of insider trading would have to be stretched very thin, and that the case against Martha was quite weak. But we had no idea how badly prosecutors wanted to "Get Martha."

In fact, as we predicted last year, Martha Stewart was not indicted on insider trading, but on charges that she covered up something that was most likely not even illegal. Martha voluntarily spoke with investigators, and a year before she was indicted Martha said she was innocent. Prosecutors now charge her statements were illegal. Can you say perjury trap?

Waksal's teeth delay prison--CNN
Thanks to some dental problems, former ImClone CEO Sam Waksal will enjoy an extra three weeks of freedom before heading off to federal prison for the next seven years. Waksal was scheduled to surrender July 2 to begin serving his seven-year, three-months prison term for insider trading, obstruction of justice and bank fraud. But according to a spokesperson for his lawyer, Waksal's surrender has been postponed until July 23 so that he can undergo a surgical dental procedure.

Martha Stewart isn't staying away from the Waksals - even though the friendship has led her to the brink of disaster. The troubled queen of good living put aside her legal woes to drop in on Sam Waksal's parents' home in East Hampton around dinnertime Sunday.

Waksal's mom, Sabina, 83, has been ailing under the weight of her son's criminal strife, while his father, Jack, 80, was in tears during the Manhattan court hearing this month where the judge handed down a stiff prison term of seven years and three months.

One year ago today, Martha Stewart hacked away at a head of cabbage on CBS' "The Early Show" while fending off questions about her insider-trading case. "I want to focus on my salad," a nervous Stewart told host Jane Clayson.

That was the last time Stewart, 61, appeared on the morning show, which served as a high-profile showcase for her domestic-arts empire. CBS News decided she could not dice or purée unless she was willing to be grilled, and Stewart's lawyers said she could not answer questions. "Nothing has changed," Jennifer Tartikoff, a spokeswoman for "The Early Show," said yesterday. "No determination will be made until her legal issues have been resolved."

If you are serious about saving Martha from the very real possibility of going to prison, please read this, because now is the time to take action. I was reading Newsweek today and on page 13 came across an article called "Prison Life: Advice for Martha." An aerial photo of the Federal Correctional Institution in Danbury, Connecticut shows the place where Martha would likely be sent if she does not prevail in court. The article tells of what prison life is like there, with 80 people in a room, no privacy, a facility that looks like a military barracks, where prisoners only get to make 15 minute phone calls which are recorded. Long days are filled with boring physical labor. It is not very pleasant. After all, it is a prison.

But that is not where Martha Stewart belongs. And that's where prosecutors want to send her. In spite of the fact that many similar cases are settled civilly, with fines and sanctions, this case is being handled as a criminal matter. We have all seen the cruel Martha parodies of decorated jail cells , and even the depiction of Martha dreaming she was behind bars in the NBC TV movie. But the picture and description of the prison in Danbury really hit me. If prosecutors get their way, Martha could be headed to this prison!

Your help can make a difference

With your help, we have been fighting to Save Martha for the past year. Since Martha was indicted in early June, we have received over 5 million hits. Many of your e-mails to us have been published and quoted in media from Reuters to the AP, from the Washington Post to the NY Post. Most of us believed this matter would have been settled in Martha's favor by now. But it has not. Now it is quite obvious that prosecutors are serious about combating corporate crime; we applaud that effort.

We believe this is not the case that will restore our confidence in the system; in fact many of you have written in that it will do just the opposite. A backlash against the extreme measures being used to "Get Martha" is growing. Without a public demonstration of this feeling, that may not be enough. Now a trial date has been set: January 12th, 2004. If Martha does not prevail due to some unforeseen turn of events, she faces serious jail time. That cannot happen.
